Washtenaw County Guardianship Lawyers
When someone is incapacitated and does not have powers of attorney in place for his or her finances or health care, that person may require a guardian and/or conservator to provide necessary assistance.
Both guardians and conservators are court appointed. A guardian is an individual who is given the legal authority to make health care decisions for an individual who is unable to make those decisions for himself or herself due to mental or physical incapacity.
If you believe a loved one needs a guardian or conservator, or if a guardianship or conservatorship has been filed against you or a loved one, we can help. For more information on guardianships or conservatorships, please call (734) 995-2383.
Guardianship Petitions
At Legacy Law Center, you will receive experienced legal representation from a team of caring attorneys and supportive legal staff. We offer extensive experience in guardianship and conservatorship proceedings.
Our attorneys can petition for the establishment of a guardianship or conservatorship. A guardianship may be established for an aging parent with dementia, or a family member with a debilitating disease, mental disability, chronic intoxication or other challenge. We can assist clients with a temporary or permanent guardianship.
We file the petition with the court and then appear before the court. The court will then appoint a guardian ad litem (GAL) to represent the person for whom the guardianship is sought. One of our attorneys, Rosemary J. Frenza, has served as a GAL, so she has a full perspective on the guardianship and conservatorship process.
We Can Help
We can petition for the establishment of a guardianship on your behalf. We can help if you want to oppose a guardianship. Our attorneys can file for an emergency guardianship if elder abuse or other significant danger requires immediate action.
We can draft a petition seeking a partial or total guardianship to establish the level of care required for your loved one. Our firm also drafts powers of attorney, which may alleviate the need for a guardianship in the event of future incapacity.
